For years, Florida has been a booming market for aesthetic medicine, sometimes called the "Wild West" due to its rapid growth and flexible ownership laws. But as we head into 2026, the sheriff has arrived.

New legislation (specifically House Bill 625) has fundamentally changed how medical spas are defined and regulated. If you are operating under the old "pay-and-pray" model—where you hire a Medical Director who you never see and who isn't listed on your paperwork—you are now in the crosshairs.

1. The Death of the "Ghost Director"

The most significant change is the Mandatory Transparency Rule.Previously, many clinics operated with a Medical Director who was essentially invisible—a name on a binder in a back room.

The New Rule (Effective July 1, 2025):Florida law now mandates that every facility meeting the legal definition of a "Medspa" must prominently post the supervising physician's name, license number, and specialty certifications:

  • On your website.
  • In a conspicuous location in your physical facility.

The Survival Strategy:You can no longer hide your Medical Director. If your current director is "shadowy" or refuses to be publicly listed on your website because they are afraid of their primary employer finding out, you need a new Medical Director immediately.MedSpire Health physicians are fully aware of this requirement and are ready to be the public-facing medical authority for your brand.

2. The "Medspa" is Now Legally Defined

For the first time, Florida statutes have created a specific legal definition for a "Medspa."

The Definition:A "Medspa" is defined as a facility offering cosmetic and medical services (like lasers, injections, and medical-grade skin therapies) "under the supervision of a licensed physician."

The "Autonomous" Loophole Closure:Many Nurse Practitioners (APRNs) in Florida hold "Autonomous Practice" licenses for primary care. Some believed this allowed them to open a Med Spa without any physician affiliation.However, this new statutory definition explicitly links the term "Medspa" to physician supervision. If you market yourself as a Medspa but lack a collaborating physician, you may be violating this new specific statute, regardless of your autonomous status in primary care.

3. The "Cluster" Restriction

The new transparency laws also require listing the names and locations of every other Medspa supervised by that same physician.

Why this matters:If you hired a "cheap" Medical Director who is supervising 50 other clinics across the state to make ends meet, that information must now be public.

  • The Risk: The Board of Medicine and the public can now easily see if a doctor is over-leveraged. If a doctor is supervising an impossible number of clinics, it invites immediate scrutiny and inspections for "failure to supervise."

4. Non-Compete Bans for Non-Clinical Staff (The CHOICE Act)

However, the good news is that this law exempts licensed medical staff (injectors, NPs, PAs). You can still protect your patient list from being stolen by a departing nurse injector, provided your contracts are drafted correctly under the existing statutes.
